Terms & Conditions

§ 1 Anwendungsbereich

  1. These General Terms and Conditions (GTC) apply to all services provided by Bades Huk Betriebsgesellschaft GmbH (hereinafter referred to as the “Resort”) to guests, tour operators, or other contractual partners.

    The services consist, in particular, of the provision, for a fee, of vacation apartments and other premises for, e.g., seminars, meetings, presentations, conferences, banquets, and other events; the sale of food and beverages (F&B); the organization of sporting events and other programs; the implementation of special health-promoting measures or comparable offerings; as well as all other related services and supplies provided by the resort. The resort is entitled to have its services performed by third parties.

  2. These Terms and Conditions apply to all types of contracts, such as hotel accommodation, package tour, block booking, or event contracts, entered into with the resort. The Terms and Conditions also apply to all future transactions with the contracting party.
  3. The contracting party’s terms and conditions do not apply, even if the resort does not expressly object to them. Any counter-confirmations by the contracting party that refer to its terms and conditions are hereby rejected.

§ 2 Vertragsschluss

  1. The lease agreement you enter into is between you, as the tenant, and Bades Huk Betriebsgesellschaft GmbH. The rental is always based on the following terms and conditions. If you purchase additional services or receive other services as a bonus—such as admission tickets to attractions—those arrangements constitute an agreement between you and the provider of the additional service. Such external services are not covered by these terms and conditions.
  2. If the contracting party enters into a so-called quota agreement, the contracting party is liable for all damages culpably caused by the end user.
  3. Subletting, subleasing, or allowing third parties to use the provided apartments free of charge, as well as using the apartments for purposes other than lodging, is permitted only if the resort expressly authorizes it. The resort may, at its sole discretion, grant a written exception upon request.

§ 3 Apartments

  1. On the day of your arrival, the vacation apartment will be available to you starting at 4:00 p.m., and on the day of your departure, please vacate it by 10:00 a.m.
  2. The rental property may only be occupied by the maximum number of people specified in the rental agreement and permitted for the respective apartment. This also applies to children, regardless of age. If the vacation rental is occupied by more than the permitted number of people, the resort may, without prior notice, remove all excess occupants from the property. If this order is not complied with within 6 hours of the eviction, Bades Huk Betriebsgesellschaft GmbH has the right to terminate the rental agreement with immediate effect and to evict all persons from the property without further notice. In such a case, the total price will not be refunded. The resort primarily rents vacation properties to families and couples. Youth groups—defined as at least 3 people, most of whom are under 25 years of age—must register as such prior to booking. The resort is entitled to refuse a youth group if it was not registered as such prior to booking.
  3. Use of the facilities (e.g., sauna, fitness equipment, children's playground, stairs) and equipment (e.g., electrical appliances) is at your own risk. Parents are responsible for their children.
  4. Please observe the house rules and help keep our beautiful complex clean. This includes, for example, properly disposing of cigarette butts and dog waste (in bags).
  5. Smoking is not permitted in the accommodations. Any ashtrays provided are intended for use on the balcony or terrace. In the event of a violation, the guest in question will be charged an additional cleaning fee of €50.00. If, as a result of a violation of this smoking ban, it is not possible to re-rent the room due to a persistent odor, the hotel reserves the right to charge the offending guest the full amount of the lost revenue, even after the guest’s departure.
  6. Dogs are permitted in select apartments by prior arrangement. Dogs are only allowed if they are listed as an included service in the rental confirmation. A corresponding fee applies per night. A maximum of 2 dogs per apartment is permitted. Dogs must never be left alone in the accommodation and are not allowed on the furniture (including beds, chairs, or sofas). If a dog causes damage to the apartment or the property, the dog owner will be held liable for the damage, even after departure. Should cleaning beyond the usual scope be necessary (e.g., due to strong odors, pet hair in upholstery, contamination from urine or feces, carpet cleaning, replacement of mattresses or bedding, or similar), we reserve the right to charge an additional cleaning fee starting at €50.00, as well as any special cleaning or repair costs calculated on a time-and-materials basis, if applicable.
    Additional charges for heavy soiling or damage (as is customary in the industry):
     Type of additional costs: Typischer Kostenrahmen:
    Additional cleaning fee: 50–150 € (e.g., for hair on furniture, urine, etc.)
    Polster-/Teppichreinigung: 80–250 € (depending on the area)
    Mattress/Bedding Replacement: individuell, ca. 100 – 400 €
    Geruchsneutralisierung / Ozonbehandlung: ab 100 €
    Physical damage (e.g., scratched door frames): nach Aufwand / Kostenvoranschlag
  7. Setting up tents, RVs, trailers, or similar structures on or near the property is not permitted. The resort reserves the right to demand their immediate removal. If this order is not complied with immediately, Bades Huk Betriebsgesellschaft GmbH has the right to terminate the rental agreement with immediate effect and to evict all persons from the vacation property without further notice. In such a case, the rental fee will not be refunded.
  8. We reserve the right to assign you equivalent accommodations within the same complex or, in exceptional cases, in the same location, if the booked accommodations are not available (e.g., water damage, overbooking) or if we would suffer financial loss.
  9. Unless otherwise specified, rent prices generally include electricity, water, and heat.
  10. Any amendments to the lease agreement are valid only if they are in writing.
  11. Please treat your rental property with care and use the cleaning supplies provided. High-gloss surfaces and chrome fixtures must not be cleaned with rough sponges or microfiber cloths under any circumstances.
  12. Bicycles, handcarts, and similar items may not be brought into the accommodations. In particular, electric bike batteries are prohibited in the apartments.
  13. The entrance doors are equipped with security locks that use an electronic locking system. Guests are responsible for ensuring that the doors are locked. If a locksmith must be called, we will bill you for the cost.
  14. Babies and young children must not be left unattended on balconies or rooftop terraces. Parents are responsible for their children.
  15. Please note that the bed linens are provided on a rental basis and must not be washed by you under any circumstances. If this occurs, our laundry service will bill us for the linens at the full retail price. We would then have to pass these costs on to you.
  16. Garden furniture is available to guests staying in the vacation apartments from April through October, provided it is available at the property and listed in the advertisement. Outside of these dates, the availability of garden furniture cannot be guaranteed. Due to weather conditions, there may be delays in making the garden furniture available.

§ 4 ZAHLUNGEN & PREISE

  1. The prices for the respective services are determined by the resort’s price list in effect at the time the services are provided. Subsequent changes to the services may result in price changes.
  2. Upon conclusion of the contract, the resort is entitled to require the contracting party to make an advance payment or provide security of up to 100% of the contracting party’s total payment obligation. The amount of the advance payment and the payment dates may be specified in the contract.
  3. Invoices must generally be paid immediately in cash or by credit card. The resort reserves the right to refuse foreign currency, checks, and credit cards. Vouchers from tour operators will only be accepted if a credit agreement is in place with the respective company or if the corresponding advance payments have been made.
  4. Refunds for unused services are not available.
  5. The resort’s payment claim is due immediately upon receipt of the respective invoice, without any deductions. An invoice is deemed to have been received by the invoice recipient no later than 3 days after it is sent, unless earlier receipt can be proven. In the event of late payment, the resort is entitled to charge the applicable statutory late payment interest.
    The issuance of a consolidated invoice does not relieve the customer of the obligation to pay individual invoices by the due date. A delay in payment of even a single invoice entitles the resort to withhold all further and future services and to make the provision of such services contingent upon the provision of security in an amount of up to 100% of the outstanding payment.
  6. A late fee of 5.00 euros is charged for each reminder. All other collection costs incurred shall be borne by the contracting party.
  7. We bill a visitor's tax / tourism tax on behalf of the municipality and forward the amount to the municipality. If the municipality changes the visitor's tax rate between the time of your booking and your arrival, the resort will bill you for the difference or issue a credit for the difference.
  8. Currently, no security deposit is required.
  9. If the rental involves a youth group as defined in Section 3.2, a rental period of more than 14 days, or a rental for a purpose other than vacation, Bades Huk Betriebsgesellschaft GmbH is entitled to charge an increased security deposit of up to €500 per person for the number of people for whom the vacation rental is approved.
  10. The rental price does not include travel cancellation insurance. If you do not take possession of the rental property, we must demand reasonable compensation for our expenses and the resulting loss (see cancellation deadlines).

§ 5 Stornierungsfristen IBE/Telefon/OTA

  1. Reservations made by the contracting party are binding on both contracting parties once they have been accepted by the hotel. In the event of a cancellation or reduction in the reservation by the contracting party, the latter shall, unless otherwise agreed, pay the following compensation:
    Daily rate, including breakfast:

    Peak Season: Free cancellation is available up to 28 days before arrival. For cancellations made after that date or in the event of a no-show, 90% of the total cost of the stay will be charged.

    Off-season: Free cancellation is available up to 7 days before arrival. For cancellations made after that or in the event of a no-show, 90% of the total cost of the stay will be charged.

    Early Bird Rate (Hot Deal / Early Bird): 10% off the current cash rate:

    Off-season only: Free cancellation or rebooking is not permitted. Cancellations and no-shows will be charged at 90% of the total cost of the stay. A 100% advance payment of the room rate is required.

Generell:

  1. Individual days of a reservation cannot be canceled. If the resort does not receive a written cancellation, 100% of the rental fee remains due, even if the rented vacation property is not occupied (no-show).
  2. In all cases, you reserve the right to provide evidence of a lower amount.
  3. Rescheduling: There is no entitlement to rescheduling. However, if Bades Huk Betriebsgesellschaft GmbH grants the request to reschedule, a flat fee of €45.00 may be charged for the rescheduling.
  4. For cancellations due to official orders (e.g., a travel ban), a processing fee of €25.00 will be charged.
  5. For group reservations (5 rooms/apartments or more), separate cancellation policies apply, which are agreed upon in the contract.

§ 6 Withdrawal

  1. If the guest has been granted a right to cancel free of charge under Section 5 of the lodging agreement, the resort is also entitled to cancel the agreement within the agreed time frame if there are inquiries from other guests regarding the booked rooms and the guest does not definitively confirm the reservation upon being asked to do so.
  2. If an advance payment or security deposit agreed upon in accordance with Section 4.1 is not made within the specified time limit, the resort is likewise entitled to terminate the contract.
  3. This does not affect the right to terminate the contract for good cause. This right applies in particular if

    – force majeure or other circumstances beyond the resort’s control that make it impossible to fulfill the contract;

    – Rooms are booked based on misleading or false information regarding material facts, such as the guest’s identity or the purpose of the stay;

    – The resort has reason to believe that the use of the hotel services will interfere with the smooth

    – that could jeopardize the resort’s operations, safety, or public reputation, without this affecting the management’s—

    – or falls under the resort's organizational unit;

    – there has been an unauthorized sublease or re-lease as provided in Section 2.3;

    – the resort becomes aware that the guest’s financial circumstances have significantly deteriorated since the contract was concluded, particularly if the guest fails to settle the resort’s due and payable claims or does not provide sufficient security, and the resort’s claims for payment therefore appear to be at risk;

    – the guest has filed a petition for the commencement of insolvency proceedings with respect to his or her assets, provided a statement of assets pursuant to Section 807 of the Code of Civil Procedure, initiated an out-of-court debt settlement proceeding, or suspended payments;

    – Insolvency proceedings are initiated with respect to the guest’s assets, or the initiation of such proceedings is denied due to lack of assets or for other reasons.

  4. The resort must immediately notify the guest in writing of the guest’s right to cancel.
  5. In the aforementioned cases of cancellation, the guest is not entitled to compensation.

§ 7 NUTZUNG & ABREISE

  1. When you check out, please refer to the checklist in the (electronic) guest folder.
  2. The renter is required to leave the property swept and clean, as well as to wash the dishes, unload the dishwasher, empty the refrigerator, remove all food, empty all trash cans, clean the grill, remove all messes caused by dogs (dog hair, excessive dirt, etc.), remove the ashes from the fireplace, and tidy up both inside and outside the vacation rental.
  3. If the tenant fails to comply with these provisions, Bades Huk Betriebsgesellschaft GmbH is entitled to charge reasonable compensation for the additional expenses incurred.
  4. If the renter notices that the vacation rental has not been properly cleaned or has damage or defects upon arrival, it is the renter’s responsibility to report this immediately. Complaints regarding cleaning must be made immediately so that the on-site team can perform a follow-up cleaning. Complaints regarding damage or defects must be made as soon as possible and no later than 24 hours after the start of the rental period or the discovery of the defect or damage. Please note that you must in all cases grant Bades Huk Betriebsgesellschaft GmbH a reasonable period of time to remedy the issue. An unreasonably short deadline automatically constitutes a reasonable period. Should you nevertheless depart before the deadline expires, you do so solely at your own legal and financial risk. Bades Huk Betriebsgesellschaft GmbH will only be able to consider a reduction in the travel price for the period for which a notice of defect has been filed or for which you failed to file such a notice through no fault of your own. If rectification is possible only at disproportionately high cost, Bades Huk Betriebsgesellschaft GmbH may, at its discretion, provide a suitable alternative accommodation instead. However, please do not forget that you are obligated in all cases, in the event of any disruptions to services, to do everything reasonably expected of you to help resolve the disruption and minimize any potential damages. Even before terminating the contract (Section 651e of the German Civil Code (BGB)), you must set a reasonable deadline for remedying the issue, unless remedy is impossible or has already been refused, or unless immediate termination is justified by a special interest on your part.
  5. In addition, we provide you with high-quality furnishings and appliances. However, even these may occasionally malfunction. Should this occur, our service team will repair them (or replace them, if possible) as quickly as possible. We ask for your understanding that, in the meantime, we are unable to provide any compensation in this regard.
  6. The renter is responsible for any damage to the property and/or its contents that occurs during the stay—regardless of whether it was caused by the renter or by third parties to whom the renter has granted access to the vacation rental. Any damage to the property and/or its contents caused during the stay must be reported immediately to Bades Huk Betriebsgesellschaft GmbH.
    Claims by Bades Huk Betriebsgesellschaft GmbH resulting from damage that occurred during the rental period must—provided the defect has been reported or can be detected through reasonable care—be asserted within one month after the end of the rental period, unless the tenant acted negligently.
  7. Bades Huk Betriebsgesellschaft GmbH inspects the vacation rental after each guest departure. If we notice any damage after your departure, we must assume that it occurred during your stay. You will be billed for the costs associated with repairing the damage.
  8. If any provision of this agreement is invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that corresponds to the purpose of the provision. The place of jurisdiction is Schwerin.

§ 8 GENERELLE BESTIMMUNGEN

  1. We also exclude liability for damage to your vehicle in the designated parking spaces.
  2. In the event of force majeure, such as natural disasters, civil unrest, orders from government authorities, terrorist attacks, fires, power outages, accidents, severe weather or natural disasters, or strikes, we assume no liability.

§ 9 Additional Provisions for Package Tour Contracts

  1. If the hotel’s obligation to provide services includes not only room and board but also the organization of a recreational program as a service provided for a fee, this constitutes what is known as a package tour contract.
  2. The contracting party may not assert any claims regarding changes, deviations, or reductions in individual services under a package tour contract that become necessary after the contract is concluded, provided that such changes, deviations, or reductions are merely insignificant.
  3. If the contracting party does not make use of agreed-upon and provided services, a reduction or refund of the total fee is not possible.
  4. The resort is not liable for any damages incurred by the contracting party in connection with the use of a special service provided by a third party. In this regard, the contracting party is directed to assert its claims against the respective provider of the special service.

§ 10 Additional Provisions for EVENTS

  1. If the agreed start time of the event is postponed, the resort is entitled to bill the contracting party for all additional costs incurred as a result.
  2. Reserved rooms are available to the contracting party only during the period agreed upon in writing. Any use beyond this period requires the resort’s written consent and is generally granted only for an additional fee. The resort reserves the right to make room changes, provided that such changes are reasonable for the contracting party, taking into account the resort’s interests.
  3. For events that extend past 1:00 a.m., the resort may, unless otherwise expressly agreed in writing, charge 80.00 euros plus applicable VAT for each hour or portion thereof. The contracting party is liable to the resort for any additional services provided to event participants or to third parties in connection with the event.
  4. The contracting party is liable for the conduct of its employees, event participants, and other support staff, as well as for its own conduct. The resort may require the contracting party to provide appropriate security (e.g., insurance, security deposits, guarantees).
  5. To prevent damage, the installation and placement of decorative materials or other items must be coordinated with the resort in advance. Any exhibits or other items brought onto the premises must be removed after the event has ended. If the contracting party fails to comply with this provision, the resort reserves the right to remove such items and store them at the contracting party’s expense. Any transport packaging, outer packaging, and all other packaging materials brought onto the premises must be disposed of by the contracting party at its own expense. Disposal may be carried out at the contracting party’s expense if the contracting party leaves the packaging behind after the event has ended. All items brought in for the event, such as decorative materials and the like, must comply with all applicable regulations.
  6. The resort does not provide insurance coverage for items brought onto the premises. It is the sole responsibility of the contracting party to obtain the necessary insurance.
  7. Malfunctions or defects in facilities provided by the resort will be remedied to the extent possible by the resort. The contracting party may not assert any claims in this regard.
  8. If the Resort procures technical or other equipment from third parties on behalf of the Contracting Party, the Resort acts in the name and on behalf of the Contracting Party; the Contracting Party is liable for the careful handling and proper return of such equipment and shall indemnify the Resort against all claims by third parties upon first written request. The Resort shall not be liable for any failure to procure the equipment in a timely manner or for any defects in the procured equipment.
  9. As a general rule, the contracting party may not bring food or beverages to the events. In special cases, a written agreement may be reached regarding this. In such cases, a general service fee will be charged, less the proportionate cost of goods. In the event of a violation, the resort is entitled to claim a lump-sum amount of damages per participant for the resulting loss of revenue that the resort would have received for providing the service. The resort assumes no liability whatsoever for health risks resulting from the consumption of food and beverages brought onto the premises.
  10. An event in the restaurant and beach area can only be held if the 12 hotel rooms on the floor above the restaurant are also rented.

§ 11 Place of Performance and Payment, Jurisdiction, Collateral Agreements, Partial Invalidity

  1. The place of performance and payment for both parties is the resort's registered office.
  2. German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-laws provisions is excluded.
  3. With the exception of private consumers, the resort’s place of business is agreed to be the exclusive venue for all claims arising out of or in connection with the respective contract.
  4. Any side agreements, amendments, or additions to these General Terms and Conditions must be made in writing. Unilateral amendments and additions by the contracting party are invalid.
  5. Should any individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. The contracting parties agree to replace the invalid provision with one that is valid and comes as close as possible to the intent of the invalid provision. In all other respects, the statutory provisions shall apply.

  5. Separate cancellation policies apply to group reservations (5 rooms or more), which are agreed upon in each individual contract.

§ 6 Withdrawal

  1. If the guest has been granted a right to cancel free of charge under Section 5 of the lodging agreement, CInt is also entitled to cancel the contract within the agreed time limit if there are inquiries from other guests regarding the booked rooms and the guest does not definitively confirm the booking upon being asked to do so.
  2. If an advance payment or security deposit agreed upon in accordance with Section 4.1 is not made within the specified time limit, CInt shall likewise be entitled to withdraw from the contract.
  3. This does not affect the right to terminate the contract for good cause. This right applies in particular if
    – force majeure or other circumstances beyond CInt’s control that make performance of the contract impossible;
    – Rooms are booked based on misleading or false information regarding material facts, such as the guest’s identity or the purpose of the stay;
    CInt has reasonable grounds to believe that the use of the hotel services will interfere with the smooth
    that could jeopardize CInt's business operations, security, or public reputation, without this affecting the authority of the—
    – or falls under the organizational scope of CInt;
    there has been an unauthorized sublease or re-lease as defined in Section 2.3;
    if CInt becomes aware that the guest’s financial circumstances have significantly deteriorated since the conclusion of the contract, particularly if the guest fails to settle CInt’s due and payable claims or does not provide sufficient security, and CInt’s payment claims therefore appear to be at risk;
    – the guest has filed a petition for the commencement of insolvency proceedings with respect to his or her assets, provided a statement of assets pursuant to Section 807 of the Code of Civil Procedure, initiated an out-of-court debt settlement proceeding, or suspended payments;
    – Insolvency proceedings are initiated with respect to the guest’s assets, or the initiation of such proceedings is denied due to lack of assets or for other reasons.
  4. CInt must immediately notify the guest in writing of the exercise of the right of withdrawal.
  5. In the aforementioned cases of cancellation, the guest is not entitled to compensation.

§ 7 NUTZUNG & ABREISE

  1. When you check out, please refer to the checklist in the (electronic) guest folder.
  2. If the renter notices that the vacation rental has not been properly cleaned or has sustained damage or defects upon arrival, it is the renter’s responsibility to report this immediately. Complaints regarding cleaning must be made immediately so that the on-site team can perform a follow-up cleaning. Complaints regarding damage or defects must be made as soon as possible and no later than 24 hours after the start of the rental period or the discovery of the defect or damage. Please note that you must in any case grant CInt Verwaltungs- und Servicegesellschaft GmbH a reasonable period of time to remedy the issue. An unreasonably short deadline automatically constitutes a reasonable one. Should you nevertheless depart before the deadline expires, you do so solely at your own legal and financial risk. CInt Verwaltungs- und Servicegesellschaft GmbH will only be able to consider a reduction in the travel price for the period for which a notice of defect has been provided or for which you failed to provide such notice through no fault of your own. If rectification is possible only with disproportionately high effort, CInt Verwaltungs- und Servicegesellschaft GmbH may, at its discretion, provide a suitable alternative accommodation instead.
  3. In addition, we provide you with high-quality furnishings and appliances. However, even these may occasionally malfunction. Should this occur, our service team will repair them (or replace them, if possible) as quickly as possible. We ask for your understanding that, in the meantime, we are unable to provide any compensation in this regard.
  4. The renter is responsible for any damage to the property and/or its contents that occurs during the stay—regardless of whether it was caused by the renter or by third parties to whom the renter has granted access to the vacation rental. Any damage to the property and/or its contents that occurs during the stay must be reported immediately to CInt Verwaltungs- und Servicegesellschaft GmbH.
    Claims by CInt Verwaltungs- und Servicegesellschaft GmbH resulting from damage that occurred during the rental period must—provided the defect has been reported or can be detected through reasonable care—be asserted within one month after the end of the rental period, unless the tenant acted negligently.
  5. CInt Verwaltungs- und Servicegesellschaft GmbH inspects the vacation rental after each guest check-out. If we notice any damage after your departure, we must assume that it occurred during your stay. You will be billed for the costs associated with repairing the damage.
  6. If any provision of this agreement is invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that corresponds to the purpose of the provision. The place of jurisdiction is Hamburg.

  4. CInt shall not be liable for any damages incurred by the contracting party in connection with the use of a special service provided by a third party. In this regard, the contracting party is directed to assert its claims against the respective provider of the special service.

§ 10 Additional Provisions for EVENTS

  1. If the agreed start time of the event is postponed, CInt is entitled to bill the contracting party for all additional costs incurred as a result.
  2. Reserved rooms are available to the contracting party only during the period agreed upon in writing. Any use beyond this period requires the written consent of CInt and is generally granted only for an additional fee. CInt reserves the right to make changes to the room assignments, provided that such changes are reasonable for the contracting party, taking into account CInt’s interests.
  3. For events that extend past 1:00 a.m., CInt may, unless otherwise expressly agreed in writing, charge 80.00 euros plus applicable VAT for each hour or portion thereof. The contracting party is liable to CInt for any additional services provided to event participants or to third parties in connection with the event.
  4. The contracting party is liable for the conduct of its employees, event participants, and other support staff, as well as for its own conduct. CInt may require the contracting party to provide appropriate security (e.g., insurance, security deposits, guarantees).
  5. To prevent damage, the installation and placement of decorative materials or other items must be coordinated with CInt in advance. Exhibition items and other objects brought onto the premises must be removed at the end of the event. If the contracting party fails to comply with this provision, CInt has the right to remove such items and store them at the contracting party’s expense. Any transport packaging, outer packaging, and all other packaging materials brought onto the premises must be disposed of by the contracting party at its own expense. Disposal may be carried out at the Contracting Party’s expense if the Contracting Party leaves the packaging behind after the event ends. All items brought in for the event, such as decorative materials and the like, must comply with all applicable regulatory requirements.
  6. CInt does not provide insurance coverage for items brought onto the premises. It is the sole responsibility of the contracting party to obtain the necessary insurance.
  7. Any malfunctions or defects in equipment provided by CInt will be remedied to the extent possible by CInt. The contracting party may not assert any claims in this regard.
  8. If CInt procures technical or other equipment from third parties on behalf of the Contracting Party, CInt acts in the name and on behalf of the Contracting Party; the Contracting Party is liable for the careful handling and proper return of such equipment and shall indemnify CInt against all claims by third parties upon first written request. CInt shall not be liable for any failure to procure such equipment in a timely manner or for any defects in the procured equipment.
  9. As a general rule, the contracting party may not bring food or beverages to the events. In special cases, a written agreement may be reached regarding this. In such cases, a general service fee will be charged, less the proportionate cost of goods. In the event of a violation, CInt is entitled to claim a lump-sum amount of damages per participant for the resulting loss of revenue that CInt would have received for providing the service. CInt assumes no liability whatsoever for health risks resulting from the consumption of food and beverages brought onto the premises.

§ 11 Place of Performance and Payment, Jurisdiction, Collateral Agreements, Partial Invalidity

  1. The place of performance and payment is the hotel's registered office.
  2. German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-laws provisions is excluded.
  3. With the exception of private consumers, the registered office is agreed to be the exclusive venue for all claims arising out of or in connection with the respective contract.
